CHILDREN’S PRIVACY NOTICE

This Children’s Privacy Notice (the “Notice”) is incorporated into and made a part of the Privacy Policy (“Privacy Policy”) of Mint Mobile, LLC and its affiliated companies (collectively, “Mint Mobile,” “we,” “us” or “our”), available at www.mintmobile.com/privacy-policy, and the Mint Mobile Plans Terms and Conditions, available at www.mintmobile.com/mobile-plans-terms-and-conditions. 

What This Notice Covers

This Notice describes the information we collect from or about children whose parent or legal guardian informs us are under the age of 18 (or the age of majority in the child’s state of residence, whichever age is greater) (“Child,” “Children,” or “Child(ren)”), how we use it, and who we share it with. This includes information we collect when you activate a Mint Kids Plan line on behalf of a Child and information we collect directly from a Child’s use of the service. In the event of a conflict between this Notice and the Privacy Policy, whichever terms contain greater protections for Children’s data shall control.  

Children’s Data We May Collect

Mint Mobile does not knowingly collect personal information from or about a Child without the express consent of the Child’s parent or legal guardian (hereinafter, “you”). You may revoke this consent at any time, resulting in termination of your Child(ren)’s wireless service. In accordance with federal regulations, we will require you to provide us with your credit card information, and authorize us to make a nominal charge that will appear on your credit card statement, to verify that you have provided this consent; the manner in which we collect this consent is described in the VPC Notice [https://mintmobile.com/verifiable-parental-consent/].

When we do collect that data, we might do it directly, like when you activate a line or any other mobile wireless service on behalf of your Child or authorize their installation and use of our mobile application (“App”). We might also collect it automatically if your Child uses the products or services we offer following such express authorization by you.  

We may collect the following categories of data with your express authorization: 

1. Geolocation Data. We collect data that may tell us the approximate location of your Child’s mobile device.
2. Unique Identifiers. We collect device and network identifiers— basically, ways for us to tell which mobile device on our network is your Child’s.
3. Age. We may collect your Child’s birth month and year to determine when we may convert their Mint Kids Plan line to a regular line (e.g., when they turn 18 or the age of majority in their state of residence).
4. Customer Proprietary Network Information (CPNI). CPNI is generated by your child’s use of our wireless voice communications services.
5. Information from your Child’s use of our products, services, and network (and other carriers’ networks when roaming domestically or internationally). This includes usage of connecting carriers and Internet service providers, IP address, phone records, and data use history, content interactions, language settings, and other network and device analytics and Wi-Fi connection and usage data.
6. Device and service performance and diagnostic information. This includes reports from your Child’s device about signal strength, speeds, App and service performance, dropped calls, call and data failures, geolocation information, and device data.
7. Audio Information. This may include voice commands your Child provides to our App and/or calls they make with your permission to Care. 
8. Any other categories listed in our Privacy Policy [www.mintmobile.com/privacy-policy], under “Personal Information We Collect, Disclose for a Business Purpose, and Sell or Share.”

How we use Children’s data

The main reason we collect Children’s data is to provide the product or service that collected the data. But we may also use Children’s data to:

1. Create and administer accounts, complete transactions, payments, billing, and requests (all of which are directed to the parent/guardian) related to our products and services and third-party products and services charged to your accounts.
2. Check eligibility for a particular product or service.
3. Help stop fraudulent, malicious, deceptive, abusive, or unlawful activities.
4. Fix errors and ensure the quality, security, and safety of our products and services and network.
5. Guide our development of children’s products and services.
6. Conduct aggregate (meaning, data that cannot be associated with an individual child) analyses of product, service, and network performance.
7. Cooperate with law enforcement and protect the rights, safety, or property of our customers, our company, and others.
8. Comply with and enforce legal and regulatory obligations and respond to government requests.
9. Enforce our policies, terms and conditions, or other agreements.
10. Defend against or pursue claims, disputes, or litigation.

Data retention

We may retain personal data, including Children’s data, to provide our services, for business or tax needs, or legal reasons. We set our retention periods based on things like the type of personal data, the business purpose for which it was collected, and legal obligations to retain certain kinds of personal data.

When we share Children’s data

We do not knowingly sell the personal data collected from Children. 

Sometimes we hire others to help us provide a product or service, and these service providers may need access to Children’s data. In this case we will provide these service providers’ with personal data of Children, to the extent the service providers need access to such information. They are required to keep Children’s data we provide them confidential and to use it only to provide the services we requested.

We may also share Children’s data with third parties, including the government, for legal processes or to protect life and safety where we believe that access, use, preservation, or disclosure of the data is reasonably necessary.

Your rights and choices as a parent or legal guardian

Parents and legal guardians have rights and choices when it comes to their Children’s data. As described above, we will only knowingly collect and use Children’s data upon your express authorization, which you may revoke at any time. Parents and legal guardians who authorized the collection and use of this data, have the following rights: 

1. To change their mind and withdraw consent to the collection of their Child(ren)’s personal data. Please note that your revocation of consent will result in termination of your Child’s wireless service and the deletion of their data except where necessary to retain for business, tax, or legal reasons; we also will instruct third parties who may have access to this data to delete the data.
2. To know the categories of personal information collected from or about their Child(ren) (and, in some cases, such as phone records, the specific data collected). These categories are described above under “How we use Children’s data” and in further detail in our Privacy Policy [https://www.mintmobile.com/privacy-policy/] under the heading, “Personal Information We Collect, Disclose for a Business Purpose, and Sell or Share.”
3. To ask us to delete or correct the personal data Mint Mobile has collected from our about their Child(ren). 

We need to collect your Child’s data (as described above) to provide the relevant products or services. If you change your mind about giving consent or ask us to delete your Child’s data, we will need to terminate your Child’s product or services. In the case of wireless services (e.g. Mint Kids Plan) we provide, the only way for us to stop your Child’s data from being collected will be to shut down the associated Child’s phone line.

Future changes

We keep this privacy notice up to date. When we make changes, we’ll let you know by updating this notice and the date at the top of this page. In addition, prior to making a material change to how we use or share your Child’s data, we’ll also reach out to you (e.g., by text or email with the contact information you have provided to us). If you keep using our products and services after we notify you, we’ll take that to mean you’re fine with the changes for any new data we collect. Those changes will not apply to previously collected personal data unless we get consent from impacted consumers.
